PESPILA reserves the right to amend and/or supplement these Terms and Conditions (AGB) in the future. PESPILA will notify you of such changes in a timely manner. These changes are deemed approved by you if you do not object or terminate the contract within one month of receiving the notification of changes. In case of objection, you will no longer be able to use PESPILA’s services. PESPILA reserves the right to continue using or delete videos uploaded up to that point. PESPILA assumes no liability in this regard.

General Terms of Use & Business Conditions for the Pespila App and Online Services

I. Preamble

  1. These Terms of Use and Business Conditions (hereinafter: T&C) form the content of the contract concluded between PESPILA Marketing GmbH (hereinafter “PESPILA”), based in Vienna, Matznergasse 10/14, 1140 Vienna, and its users (hereinafter “USER”) regarding the online services and smartphone apps offered by PESPILA Marketing GmbH, in particular the Pespila Apps (hereinafter “APP”).
  2. PESPILA operates a website under the domain [www.pespila.com].
  3. The videos mentioned under I.2. are uploaded to all social networks and PESPILA’s homepage with the aim of marketing the USER as effectively as possible. Coaches, managers, and clubs worldwide will have access to these videos.
  4. The purpose of these Terms of Use is therefore the use of PESPILA’s APPs and online services by the USER.

II. Conclusion of Contract

The contract between PESPILA and the USER is concluded through downloading and/or installing the APP and/or registering an account on http://www.pespila.com, thereby submitting to these T&C along with the transfer of the rights specified under IV.3. to PESPILA on the one hand, and the acceptance of registration and rights transfer by PESPILA on the other.

III. Registration

  1. The USER can use the website without registration and view all services available for unregistered use. However, if the USER wishes to place any content on the website, they must first register with PESPILA by creating a user account. Registration is free. By registering, a contract for the use of online services is concluded between PESPILA and the USER.
  2. The USER must provide their full first and last name, a valid email address, and current residential address during registration. Additional information is voluntary.
  3. The username must not consist of an email or internet address, must not violate third-party rights—especially naming or trademark rights—must not contravene public morals, and must not be vulgar, racist, or offensive in any other way.
  4. During registration, the USER must choose a username and password.

IV. Functionality of the Pespila App

  1. The APP is downloaded and installed by the USER on a smartphone. It allows the USER to access videos integrated on their smartphone…

XIV. Final Provisions

  1. Austrian law exclusively applies to any contractual relationship between the USER and PESPILA. The application of UN Sales Law is expressly excluded.
  2. Any disputes arising from this agreement shall be settled by the competent court in Vienna.
